Hello!!!

I've had a frustrating week...

Last week I sold my domain name on Sedo insurance.casino for $$$$ to Sriram Gopalan. He immediately wanted a receipt with my signature. (Red flags are going up.) I waited and waited and no payment...then I decided to do a name look up and I found my domain for sale on Dan.com with Sriram Gopalan listed as the owner. :rage::rage::rage::rage::rage::rage::rage::rage::rage::rage::rage:
I contacted Sedo and they said that his cc was rejected due to security reasons. They would try a wire transfer and then cancel the escrow.

I CONTACTED DAN.COM
(See below)
Sriram Gopalan is selling insurance.casino on your site.

He bought the domain from me on Sedo over a week ago... but has yet to pay for it...so he should not be selling a domain name he does not own.
Their reply:

Thank you for notifying us.

Please grant a print screen of the domain residing in your registrars account and I will make sure to remove the domain for you.

What kind of security does DAN.COM use??? I guess anyone can sell a domain without verification??? Why am I on the hook to provide them with proof of ownership??? HEY DAN.COM - SHOULDN'T SRIRAM GOPALAM BE PROVING HIS OWNERSHIP OF THE DOMAIN???

PS Everyone...it is STILL UP FOR SALE!!!!

The views expressed on this page by users and staff are their own, not those of NamePros.
ONLY if you're trying to sell it at the same venue.
If not don't lose any sleep over it.

Well here the problem. My registrar is ALSO put that domain on sale. Weird right? I did not know it came from Afternic. Domain was on Dyna as my registrar. I was afraid that somone accidentally checkout my domain. So I contacted Dyna and they said the sale from Afternic. So I had to contact Afternic and removing there with proof if owenership.

It's not that simple. To list the domain the dan.com user already made a claim of ownership now the OP is making a claim of ownership. So since the OPs claim is more recent why shouldn't she be the one with the burden of proof?

Let me simplify this for you...
Because it's sitting in her account!

I understand that accidents happen...maybe someone forgot to renew or something...but this is no accident...this is scamming. I am hoping to shut him down and warm others about him.

What if the 2nd claim is from somebody who is not DAN customer, and is not looking to sell the domain on DAN? Why would the real owner send an ID or screenshot or anything to somebody they have no business relationships with? Yeah, sometimes it may be easier. In this particular case especially. Making a screenshot and attaching it to email is just ~`30 seconds. But it should not be considered as an obligation. DAN might well request ownership proof from their current customer (who listed the domain) instead...

My point is its bot simple. There are essentially two dueling claims or ownership and so someone has to provide proof unless WHOIS data is publically avalible to settle the ownership question. It is therefore no more or less right to make the new claim provide proof then to make the current literacy or older claim to prove it. As a rule to make the person making the newest claim is simply just a simple rule of thumb. Usually someone would make such a claim so they could list the domain on the marketplace themselves. If you are not going to list the doma and n on dan.com then honestly it doesn't matter because you are not obligated to that sale because you didnt list it.

As far as I know this is my thread...I can post whatever story I want to post and tell my story however I want to.

...except - there's 1000 or more persons with the same name (Sriram G.) & your thread is already indexed by Google, Bing, etc. Search result for Sriram G(full name) is on a page 1 or 2.

What a shi**y year or two for someone like ... innocent Sriram G. adviser @ T/*A/*T/*A/ M/*o/*t/*o/*r/*s/.

Regards

She stated she listed it on sedo but the non paying buyer listed it on Dan.... Why the hell does she "The owner" have to prove anything at all?

Great. It will just take a few hours for them to see your message then it will be removed.

If someone regularly list domains for sale on marketplaces that they don't own it will catch up to them when someone trys to buy it and they can't deliver.

Biggest point you're missing....

Brokers sell domains that they do not own for others via their DAN account.

You do not need to be the registered owner to list.

I have domains listed in my portfolio that I do not own, at the request of the owners.

Why?

I get exposure to my portfolio that they wouldn't.

She already said she sent it so it's really a moot point but she was asking dan.com to take action and remove it so she has to be the one to prove she owns it to justify that demand.

Absolutely...all other Sriram Gopalan's should contact Dan.com and get this turkey off of their site and away from scamming innocent people.

Omg...Thank you so much!!! I appreciate your kindness. You know I am new to your site...I do not feel very welcome...I set out to alert others so that this doesn't happen to them...and to call out Dan.com to be more careful.

What's moot is arguing with a 4 month old newb that doesn't understand that the responsibility of proving one self doesn't mean anything when their legally not responsible for the initial action taken.
I'm schooling you son, pay attention.

May be yes, may be not. In this case if SEDO did not catch the fraud, it may get harder to track it because another innocent buyer will buy the domain from DAN as stolen property/domain. If that happens then the thief is now holding the money, no just a domain.

Sadly it is not uncommon for people to do this. Find a buyer for a domain they do not own then if they find a buyer they will try to buy it from the current owner for less than they sold it for and pocket the difference.

It's basically like they are acting like a broker but without the owners permission.

The problem is marketplaces like dan.com want to make listing domains easy so people use their marketplace.

Personally I am at the point where unless I intend to list a domain on a particular marketplace I dont worry about trying to remove it. And 9 times out of 10 it's not someone maliciously listing it, it's usually a previous owner who never removed it after letting it drop or selling it.

No that's standard of any marketplace. Afternic, Uniregistry, even Sedo. If I emailed sedo and said I was the real owner of one of your domains and wanted it removed they would require me to verify ownership not you.

Unless there is an express agreement to broker a domain for someone via written contract it is wrong to list a domain for sale you don't own.
