Yet another TM question- the "Humor Weasel"

What is the Humor/Parody clause for domain names, i.e.
I have ViagraJoke.com and ViagraJokes.net. Wouldn't a Viagra Humor site be somewhat isolated from any potential violations of TM or domain law?

Also, what about my other name, ViagraBlog.com
Wouldn't it be isolated from claims because it's a "journalistic" site about the "Viagra Phenomenon"?

I believe Phizer has that name TM battend down tight.There main reason is they pay huge bucks to advertise viagra on the 6 car in nascar as well as sponsering several other events,I would'nt chance it,Just my OP.

Andrew, aren't you putting yourself at risk by actually stating the domains you
have potential legal questions about?

Probably a dumb question, but is viagra now considered a "generic" name, so
to speak?

I ask this because if viagra is considered such, ideally you should be safe. Well
ideally, anyway, anything goes in the real world.

What matters more is how the domains are used.

As to exposing myself, I wouldn't have hand-reg'd the names if I thought the risk was enormous. There are about a jillion ACTIVE viagrasomthing.com's out there, and when and if they start a campaign to C&D them, I would probably be way down the list. I would never directly distribute ED meds, so my level of risk as a sucker-fish affiliate is minimal.
IMHO, of course!
