So it's been interesting registering some of the gTLDs so far. I only have around 10 right now, but I recently ran into a TM Clearinghouse warning upon looking up CreditCheck(dot)today.

"Applicant: Consumerinfo.com"

**First Thoughts**
Well shit, thats a BIG ass fish I don't wanna mess with. Last thing I need is Experian mailing me a letter other than my credit report.

But then I started thinking about how common the term "Credit Check" is in various marketing promotions with different companies.

So I finally decided to check on uspto and turns out its DEAD and was abandoned in 2005..

Now that doesn't set me 100% free and clear, but there have been multiple attempts by various companies to trademark the words "Credit Check" in the same class. All abandoned. My guess is that they TM'd but could never get people for infringement because of its common use.

Either way I'm still surprised ICANN is passing dead trademarks thru the clearinghouse.

I did purchase the domain and for now it's on the backburner. We'll see where this leads.

I was curious about the "dead" status because i reg'd a new gtld and looked it up and it was classified as "dead" but there is a .com web site that uses the term and they have a R after the words. But how can they have a R mark if the TM is "dead"?

I reg'd

MyLED dot lighting and there is a MyLED com. i looked it up before regging and i thought it was good.

Should i just drop this or can i legitimately develop this as a lighting site.?

DEAD trademarks don't necessarily mean you're safe. But it certainly does make it much more difficult to make a claim and forces the applicant to rely on common law.

To be honest I don't know much about LED lighting or what the market for it is like.

1-the US isn't the only place to register a trademark. Even in the US a trademark can also be registered in some (maybe all, not dure) states.

2-a trademark can be valid even without registration, registration provides more legal options for enforcement to the trademark registrant.

3- have no clue what requirements exist for the clearinghouse applicants, but it's always wise to do your own due dilligence.

I grabbed a few key words for the niche i focus on.

LED was taken so i checked MyLED and LEDit both were there so i grabbed them.

I was given a warning when i went to reg a name and so i did a madrid search and nothing came up so i regged it
