It depends. Cctld owners own them for a reason- local use! These set of people rarely consider anything outside that because they see their business as only local and feel it should carry the local tag. You can still try it though.

I wouldn't.
Just to reg it and offer it to them is a sign of bad faith.

Plus some of those .com.br owners are reverse domain hijackers and sue happy, just ask Rick Schwartz about SaveMe.com and .com.br
So if you offer it to them they just might want you to give it to them for free or else.
Also you might want to check if there is a TM for their company name.

Provided your website does not infringe on their trademark, and you wait for them to approach you, you should be ok. But I'd be wary of what lennco has said. Personally, overall, I'd find another place for my money.

It's hard to know without knowing what the domain is. I've seen a few times when a company has an alternate extension and the com becomes available. Most of the time they have a trademark on the brand though.

There are lots of cases where companies will just pay you since it's cheaper and easier but... you could be one of the those unlucky ones that gets sued.

WIPO arbitration fee is about $2,000 US Dollars for single panelist.

For the domainer, no fees collected, but you will have a permanent naughty boy record that can mark you as a repeat offender in the future.

in my opinion, we need to see the domain name first.
If the domain name is TM better to avoid it.
If the domain name is common name, we can consider it.

example
oilandgas.com
topbattery.com
and others

This Domain name is registered by someone in 2009 and expired two days ago so there might be a little hope..:D

It is impossible to be unregistered if it only expired 2 days ago. I think its very much too premature to be discussing this at this point in time. You should tell us the status on day 30 and where it is registered.

What about other extentions?

If .net .org and some others are taken and not used by the CCtld owner, I would registered it with no hesitation and wait for the buyer.

I did it with a .net and 3 days after I sold it for $xxx and paid the domain 50 cents :)

In the same situation as the OP. Was doing research on a different name a few days ago when another similar name just came to my mind, checked the name and found all the top extensions taken except the .com. Google search showed the existence of a company with that name with hyphenated version of the name and another company with the ccltd extension. I reg the name immediately.

Have to do more research on the name to get a perfect picture of the situation. The name was registered in 03 and just dropped. I guess the other extension owners just settled for what they could get.
The plan is to contact both and offer the name. Also would contact the other extension owners.
