I have over 3300 domains, I would never register or buy a trade marked domain. There are laws, cases brought in front of the courts for trade mark violation, infringement, deformation of character, I could go on and on.

You can't register and sleep in peace with a name like microsoft2.com or 2microsoft.com

It's absolutely bull. You're asking for a cease and desist plus damages in a court.

Please think before getting smart.

I get hundreds of emails a day to buy a domain, I laugh at how stupid people are registering famous people's names or company names.

Get real kids.
You have legit domains for sale I'll buy them anyday. Don't do the wrong thing.

Yeah, it is kind of retarded how people register things they know will just pick bones with them. Except for that guy Mike Row, and he developed software and had MikeRowSoft.com for an honest reason, and got sued over it. But like Mikrosoft.net or Ipodz.net or just big TM violations that the small guy can't afford to win, are just pointless to register. I usually only go for word domains because it's really hard for anyone to have legal issues with those.

I don't touch any famous persons name, trade marked name, copy right name, or celd/actors name. I don't need the excitement.

A typo of a common word is not a problem for me, but nameprs.com would be a no no for me. It's just plain simple wrong to try and steal some one's business. Not to mention if they come after me for damages.

hiltonsex.com I would take it if it was given to me on a silver plater, hilton is a trade marked name and I'll here from hilton corp sooner or later and loose the domain. Plus maybe pay a fee.


That's just my 2 cents.

I thought I was discussing and answering a question about domain names. What was wrong in my post?

You can't trademark a domain name. Owning a domain does not create an infringment.

Registering Hilton.com or HiltonHotels.com might get you letter, possibly a UDRP, maybe land you in court.

Over the years, I've recieved two complaints. One from a domain owner, the other from a lawyer. Neither went anywhere.

The first course of action is a UDRP which cost more to file then most domains are worth.

Respectfully I disagree. You can not regiser a trade marked name and keep it, you will get more than a letter in the mail.

Yeah... And since your talking about a major owner of Hilton Hotels (Paris Hilton) don't expect they'll take it litely.

Well said. That domain I used as an example is playing on the hilton family name, hilton hotels name and trying to cash in on Paris Hilton. Their lawyers will have you for lunch before you have time to order the appetiser. In my head that's plai cyber squatting and nothing more.

My sentiments exactly. Shouldn't have been registered in the first place. It's a blatant rip off on the Paris Hilton/Hilton Hotels good will.

I wouldn't take it if they gave it to me on a siler platter as I said earlier on this thread.

But Hundreds don't understand what I initially said on this thread.

If you intend to buy and sell domains get educated on what is right and what is wrong. Ignorance can come bite you in the soft parts if you play dub.

I've been offered domains so many times where it was wrong legally and ethically to register in the first place, and I turned them down all the time.

Millions won't understand why but I don't care.

this brings that google.ru case to mind. That guy got sued within 1 month of buying the domain name. of course thats because because google was in the process of getting permission to actually buy that domain name when someone else got it. there have also been others with nokia, but the guy ended up losing the domain name, and getting a free nokia phone with free service for life LOL..... someone on this forum as a matter of fact had bankone.ru that ones going to be lost soon when they expand....

The domain is already sold. Do a quick search on whois.sc for paris hilton or even just hilton.

I doubt anyone here is a lawyer, no one is quoting US or international law so it really just boils down to what you think the law says.

I do agree with you that registering a name like 2microsoft.com or any other international trademark may bring you trouble.

On the other hand registering a domain like corinthinans.org or madonna.com will get you just as much trouble, neither of them are trademarks in the US or International law but both were targets of reverse-hijacking via the world court at the UN.

I glad that someone with 3300 domains agrees with me. Now I feel smart LOL.

Just tell them and see if they'll take it for free and not press charges or anything.

Paris Hilton doesn't own anything but a trust fund. Her parents own everthing. Her sister is a sucesfull designer but I don't think paris has done anything but star in bad tv shows and a porn video.

To each his own, but I would not touch hiltonsex.com with a 10 foot barge pole. It's a blatant rip off on hilton hotels and Paris Hilton. Cheap low blow under handed explotation of another legal entities good will, fame, fortune, trade mark and reputation.

But hey want to buy it don't tell me later on I didn't warn you.

I see some intelligent people here and a lot of people with no clue what they are talking about. I make deals all day long on my board and I have never seen so many people with no clue about legal issues and domains. I think I'll stop posting here.

Yea, thats why the courts are full of law suits over the video and ICANN is backed up with UDRP cases filed by the Hilton attorney's.

FYI, I registered the name BECAUSE of Paris's exploits. I sold it for the same reason. You don't have to register a domain to commit trademark infringment. All you have to do is use the the name "Hilton" in an in appropriate way.

No hard feelings but I don't think you really know what you are talking about.

You may not like the fact I regg'd and sold the name in less then three days by capitalizing on Paris Hilton's fame but that don't make it illegal or wrong.
