Considering a PHP NUKE Portal for this name.

I think it has a lot of potential. Its got rythm and style and it is a .NET. Microsoft loves their .NET

What would you do develop or sell?

Also does anyone have experience with getting a board going and generating revenue. If you can prove your salt I will pay for consulting.

What does ZUNEzone have to do with PHP? It would certainly require branding if used for that. As such, reg fee.. potential TM issues (conflicts with MSFT's ZUNE)

PHP NUKE is just an open source bulliten board package much like NamePros.

So to avoid TM issues I would not be selling any products. Rather it would be a place a person could go to converse about the product. Freedom of speech is protected by the First Ammendment. Could be an easy case to have thrown out. Many of the cases I have seen regarding the IPOD domains have been merchants selling the products. I have yet to find a case involving a discussion board. But I am certainly looking hard.

If microsoft did take you to court over this domain name I doubt that it would be that easy to have "thrown out". Personally I would stay away from anything involving a microsoft product.

But thats me.

About the TM issues.. Microsoft has two ways to go about this. Either they let live and enjoy the free advertising, or start a pointless war against all things named Zune. I don't think they're going to go after everyone with a Zune in their domain name.

Actually a trademark does not even have to be registered to be considered "protected" under common law.. best to be careful either way.

True, but I think only if it is already a household name (do correct me if I'm wrong - I'm no law expert). Zune was just a rumour at the time. But yes, I agree, one needs to be careful. But not too careful! Might miss some big opportunities. Anyway, if microsoft demands your domain name, you'll only lose the reg fee...
