Tricky Ad Placement Against Google's ToS?

Just curious.. If your ads are placed in "tricky" places, and that results in a high CPM, is it against Google's ToS?

By "tricky" ad placements, I mean strategically placed ads that users are more likely to click on.

If that's your definition of tricky then I'd say no problem, Google give pointers to people on where to place ads for highest clickthroughs with their heat map:

If, however, you are trying to trick people into think the ads are your menu, then you may get in trouble.
