So a domain I am desperately trying to re-obtain from someone basically holding it hostage from me - and actually have valid legal claim to, but don't want to legally pursue (yet) - is currently under GoDaddy suspension for having invalid Whois information.

The company that owned the domain folded and the Whois registrar was obviously no longer with the company, so GoDaddy audited and suspended it.

The #*$!s have it registered till 2016, but have NOTHING on the site, and will probably not realize for a VERY long time that it is suspended, since they aren't getting the emails from GoDaddy and have had a dead site for the last year, so it looks the same.

Already put a godaddy backorder on it, but according to them, this won't work until AFTER the expiration. What else can I do to try and get this domain back without suing?

HELP!

Very fwe people / co. register for that long,
Long registrations are done least for an intention of buying / selling

if you're willing to wait until 2016 that is..

but godaddy and ICANN are serious and firm about these invalid whois issues even sending them an email or calling them up can't do you any good.

Click over to Internic WDPR system and file a report...

Note the fine print at the bottom regarding receiving a confirmation email.

If still not corrected in say a month, file another wdpr report, and also file a registrar complaint too with ICANN for them not taking action on the wdpr.

p.s. also at some point try emailing godaddy and inquire if they're willing to sell you the domain - maybe someone here has a contact at GoDaddy you can direct your purchase inquiry to.

Go Daddy apparently did from what the OP described.

I'll correct my answer previously since RJ said it: UDRP aside from not suing.

But did the OP file an ICANN WDPR?

Doing so may prompt GoDaddy to "delete" the domain so as to make it available for resale.

I actually filed the WDPR before the complaint with GoDaddy, not sure which one triggered the suspension. Maybe I should file the WDPR again?

Edit: just saw the note about filing again, just did it. Hopefully this will get something moving. If not, onward to the UDRP...

Ok. That's good. I'd say wait about two months from the time you first filed before doing so again. GoDaddy will often send out out notices to the registrant over a month or two to update their whois info.

As another poster suggested, UDRP may be easiest, and likely much faster; you'll know more or less exactly what it will cost to go that route verses buying it from GoDaddy / drop service...

On a related note, from what I recall, some people have had success buying suspended / deleted domains directly from GoDaddy without going through their associated drop service. You'll need to ask around for contacts at GoDaddy - assuming you have a solid UDRP claim, them selling it direct to you would likely be most advantageous financially for both GoDaddy and yourself.
