PayPal Tells A Buyer To Destroy A $2,500 Antique Violin Instead Of Returning It For A Refund

According to Erica, she sold the violin to a buyer in Canada, who disputed the label. PayPal declared the violin "counterfeit" (which Erica says there's no such thing in the violin world), and told the buyer to destroy the violin if he wanted his money back.


The link explains more about why:
"...in many countries, including the US, it is a criminal offense to mail counterfeit goods back to a seller."


Was it really counterfeit?

If the violin was counterfeit, what would stop the seller from trying to sell it to another unsuspecting buyer?

Policy has merit and "counterfeit" is pretty cut and dried on things like designer knockoffs. But does PayPal have the expertise to determine "counterfeit" on a niche item like an antique musical instrument?

I read the entire article, and I have changed my mind.

If Paypal *thinks* it's a counterfeit just because a buyer says so, then it should pay for an appraisal of the item before requiring its destruction.

Wow. I hope the seller sues.

Never sell any high ticketed item on ebay.

Exactly! How can anyone tell by email or by phone that a Violin is counterfeit? Absolutely ridiculous and just so unfair on the Seller. I hope she gets her money back from Paypal. I'd be very unhappy if I was out of Violin and Money just because someone (who is not the 'counterfeit police') decided my Violin was counterfeit without getting expert opinion and asked for it to be destroyed!

Okay, so some guy collects these violins, buys another one, says it's a counterfeit, and then shows a picture of some spare parts surrounded by some snapped pieces of wood.

Fake painting, drawing, vase, lamp, just about anything.

But why the law against sending back the fake, because you'd be using the government as the carrier, or some kind of draconian law?
