Hi, I’m in a situation that seems to be getting complicated. As I mentioned in another post I have received a C&D regarding a domain that I am willing to transfer. The person who wants the name is a reseller. I have just discovered that his site lists for sale; pages and pages of names that, as I understand the definition , are very high profile TM domains and are registered to him. Names of huge corporations, and he is suggesting prices up to a million dollars (not .coms, not kidding). Now, I don’t know how to proceed. If I transfer the name to him, it will undoubtedly end up resolving to this site with all the TM domains. My question is-
Would the fact that I had transferred the name to him associate me with him legally ? Basically, when the corporations whose names he’s trying to sell come after him, am I implicated because I had transferred this name to him which then resolves to his site. I would greatly appreciate any opinions on this, At this point I don’t know what is the right thing to do.

If the person who sent the C&D has no legal rights to or enforcement of the TM, then just ignore it. If he is a reseller, he has no rights at all. If he extorts you, maybe you should rights letters to all the TMs he has :)

Make sure you know who you are dealing with. I would ask for a phone number at least to verify.

I really don't know why people panic when they get a C&D...for me it's GOOD news...it means that someone wants something I have.

I've gotten these emails from people claiming to be attorneys from huge well known companies but have yet to up a name.

It's been close to a year since the last letter but expect more in the future.

If they want it, they can call or write Icaan as far as I care.

I'm not here to give names away at the opening of an email, but that's just me. :yell:

i dont get it- you have a tm name, of a company- and a reseller wants it? is HIS company name the domain name you own??

Never ask someone you are suspicious of for their phone number to prove who they are.

What would stop me giving you my phone number and claiming I am Bill Gates. If you want to verify who you are dealing with ask for his name and a few details about where he is within the company (such as his title and what office and department he works in).

Once you have that information you can phone the company and make inquiries, if you get forwarded onto him then you know he does indeed work for the company. If they have never heard of him or cannot trace anyone by that name then the chances are he is lying.

Is there any reason you can't reveal the site with all the TMs? Might help one of us down the road to know about this guy.
