You can cancel it. Godaddy.com has a very easy procedure to allow you to do this from your control panel. Other registrars require you to contact them.

It may take a little while for them to drop to the registry though.

You can contact the registrar's support and they'll usually delete it for you.

Or you could just give it away to someone here. If the quality of the name is good, some people won't be bothered by any trademark issues.

You would receive a cease and desist letter from the counsel for the TM holder listing certain requirements i.e. relinquishing ownership for the offending name and you might be required to sign an agreement which states that you will never register or own any domain name that includes or is confusingly similar to the offending name.

If it’s legitimate and you don’t respond to it you will most likely receive a WIPO Complaint within two weeks.

My advice would be to not panic and to try and work something out.
