Hi,

I have a party interested in my 1-word domain. He came out with a $7k offer (I have received 2 offers in this range within 2 months). We then ended up at $14k as long as he was able to pay within 48 hours through escrow. They're using it for a project.

This was agreed.

I didn't hear back from them so I responded to them about our terms. He then responded stating that they have a TM issue with the use of the domain in EU.

I'm not sure how I should respond to them?

The buyer seems to be a great entrepreneur.

sounds like generic enough... but sometimes that impression can be wrong.

I just had a new reg I made few weeks ago.. s h o w t i m e s.gtld.... not accepted into gd auction due to tm issue. they never say which. but it's a tm issue. so go figure. this tm stuff is quite odd.

as for your issue.. well.. this isn't exactly an auction sale.. like GD.. or other.. where buyers always feel more pressed to complete.. and where you can press them more to complete... with email agreement, you are at the mercy of their word.. and the extent of their honor to keep it.

this is why upon any agreement via email to sell, it's always

all the best.

Once a while, you need to educate people. Do not just stand there because you have no idea if someone has misinformed your buyer and he took it without investigating. So, go back and educate your buyer NOW!

He bided on the domain when it was listed before.

When you had it at Godaddy auction, right? Tell him he wouldn't have any problem because the name is generic enough.

The guy I'm dealing with is pretty familiar with domains.

I responded asking for an update.

I can tell the OP my guess is he won't complete now.
He has likely made up his mind and won't come back (I hope i'm wrong though).

Still the domain has a ton of interest so no big deal someone's going to buy it soon.

received an email stating:

We tried last week to clear the trademark issue with the other party without progress.

Let it go bro. Just sell at auction where it is now and make whatever profit you can as long as you do not record loss.

Another thing to consider is that he might have changed his mind regarding the purchase and do not want to tell you directly and so, he is playing the TM card just to make it look like it isn't his fault.

Most of these guys act that way you know? Just move along bro. You have done well for yourself already.

People uses all kind of Shits excuses to get negatively advancement on you. Some people just like to create issues. When someone tell you your domain is TM because looks like it, sounds like it, looks similar, maybe because, because it has this and that DO NOT LISTEN. They are jealous and they trouble makers. They have zero knowledge what soever; however they claimed to be. Because they have in this industry for all these years. Do not listen!

my first mind says, that it's a jedi mind trick, to deflate value

if the party "is pretty familiar with domains", then before agreeing to $14K deal, they should have done due diligence, prior to.

but i could be wrong

imo....

What if they have seen the domain being auctioned somewhere?
