Hi,

I have a party interested in my 1-word domain. He came out with a $7k offer (I have received 2 offers in this range within 2 months). We then ended up at $14k as long as he was able to pay within 48 hours through escrow. They're using it for a project.

This was agreed.

I didn't hear back from them so I responded to them about our terms.He then responded stating that they have a TM issue with the use of the domain in EU.


I'm not sure how I should respond to them?

I think that''s your answer.

The buyer may have thought (based on your BIN price and high interest in the DN) that the auction was likely to reach a high number, hence his private offer. He's now reassessing the current high-bid and playing his hand in risking a last-minute saving on the acquisition (planning to counter your previous agreement-in-price if the auction ends unsold on a low amount).

I would stick to the 48hr timeline and give him the courtesy of an update with regard to the $14k offer that has since expired (ie. it's off the table). That's to say you don't mind holding on to it for a while longer. Any other message to the buyer could possibly show desperation for the sale or a change in your perceived value of the DN.

Anyhow, if he is being honest about the TM then you're not really losing a sale by sticking to your guns. Don't assume he's a stand-up businessman if you don't know him personally.

Looks like an attempt to try break you down a little so that they can comeback with some story about them going ahead with taking the domain but at the "risk" of TM violation so because of this risk you need to lower your price... or some kind of blah blah blah excuse like that...

Don't respond to them for now. Just forward your domain to the auction. Make sure you don't sell it for a loss. Good luck mate!
