Although my family name is less generic, for the sake of this question i'm going to use Jones as the example family name.

If a squatter was sitting on the domain Jones.com for no apparent reason, and has no association with the word Jones at all, would I, with the surname Jones, have any right to claim the domain as my own in a legal sense?

Im also going with no. The idiot that registered "BIARS.COM" stopped using it for "Business Information and Realty Systems" so I offered to buy it. The person doing his website decided to be an @$$ and registered it for 15 more years. HA.

The only way you can get it is if you have a valid trademark claim.
