Domain name already taken per whois....

I registered a mobi name last month with Hostway and when I was checking Whois, I saw the name was registered to someone else. It's a pretty good name by the way. I emailed Hostway about it and they haven't responded yet.
I even bought a safe guard for it so no one would steal it from me. Is this common and will I loose this name?

Is the date of registration to the other person the same as the day you registered it???

Its happened to me a number of times hell I thought I had online.co.uk / casino.mx casino.jp.....only to find a couple of hours later it wasnt free in the first place....doh! annoying.

Other person registration may have been in que at the registry when you tried also.
