I know, I know.
This time, I actually searched "Trademark" on Google for a week ;)

Just a quick question. If a TM is listed as 'Dead', then it no longer applies, right?

No. They may still hold "usage" rights. Although, you my be able to apply for it and get it.

LOL, but it is a good question, though it has been asked, but not often as the others.

A registration can be dead, but an entity could still have a common law TM. There are many reasons why a registration could be dead. But it is not an end all and free for all to use.

To be clear, the question you should be asking is whether the owner of the TM registration or their successor in interest is still, in fact, using the domain name.

If my dog's license has expired, it can still bite you.

One more thing ... a TM registration listed as "Dead" in some instances can be "revived" for a period of time, which can vary depending on circumstances, afterwards.
