Can a dead TM come back to haunt you?

I'm looking at sites using a colloquial 3 word phrase. I checked the patent and trademark office and the phrase was TMd as part of a 4 word phrase, but that TM died in 2001. It is also part of a 6 word live TM phrase, that pertains to a different industry entirely. Is either one any cause for concern?

What about if I want to register the full four word phrase on the dead TM?

Thanks!

I have read before that this is not allowed, but i do not see why if it has been registered so long.

Not sure I follow. You mean "if it has been [dead] so long"? Are you referring to the question about registering the full four word phrase?

Thanks.

Sure. But just be aware that someone might be using the terms somewhere in
the world as a trademark, registered or not.

After all, USPTO isn't the single most authoritative trademark registration data
base in the world. Then again, there isn't any either.

What reason is the registration dead? Is it due to non-renewal? As John's favorite saying goes... If I fail to pay to renew my dog's license tags, is it no longer a dog?
