Bad Experience With GoDaddy Domain Sale

I have sold a domain name @ Godaddy Aftermarket on September 23, 2013 which was registered @ Name.com.

After the payment is confirmed by Godaddy I sent several emails to the buyer using Godaddy sales platform asking his push details. When I didn't receive any reply from the buyer I sent the authorization code via Godaddy platform. On 10th November 2013 domain expired and deleted from my account. I didn't renew the domain as its not worthy for me to renew even I sell the domain or not. Also i don;t have any responsibility to renew it as its sold already.

On 12th November buyer contacted me via email asking me to push the domain to his name.com account (Buyer is a well reputed domain selling company, Name*****.com). I said the buyer that domain expired and deleted from my account as he didn't take any action to transfer the domain.

On 5th December Godaddy sent me an email asking to transfer the domain to buyer if I have the possession of the domain. If not they ask me to return the money I received from the sale.

I rejected it saying that buyer waited 50 days to ask for the transfer and its not my fault.

The response from the Godaddy is so frustrating.

Regardless of where you believe the fault lies, the net effect was that you were paid for a domain that was not delivered. If you had any intention of finding another Buyer for the domain you would have needed to renew it in order to put up another auction, which obviously you did not do. Per the instructions sent to you on December 5th, those funds need to be returned.


My questions are;

1. How can I transfer a domain to another persons account if he or she didn't accept it?

2. Do I have the right to sell a domain somewhere else which have already sold at Godaddy?

3. Can a buyer wait for 50 days without accepting a domain? what will happen if he wait 1 year :o ?

4. Finally who is responsible? Me, Buyer or Godaddy?

Buyer did kind of a jerk thing by waiting so long (probably to get you to renew the name at your cost), but GoDaddy is right - the sale was never completed, so why do you think you are entitled to the money? You should have just refunded it when the name was no longer in your account. You could have also renewed the name and canceled the sale.

If you thought enough of the name to own it, and you had at least 1 other person interested in the name, why wouldn't you have renewed it anyway?

Its not Godaddy's fault, in my opinion both buyer and seller did the wrong thing. Buyer waited for a long time and seller denying his responsibility to renew the domain name before completing the transaction. .:D

Sorry to hear about this BladeMaster - that definitely sucks! Did you ever mention anything in the emails to either the buyer or GoDaddy about the domain coming up for renewal? Was GoDaddy aware the name was expiring and needed to be moved ASAP?

I've had to contact the auction side of GoDaddy before for offers I had accepted but hadn't been completed by the buyer. They were pretty friendly and quick to get back to me. I would've sent them a quick email 20 or 30 days before it expired and told them the buyer paid for it and you weren't renewing the name.

Since they were technically the "escrow" company here, the ball would be in their court because they're the middle man. I'm sure they would understand that you're not going to renew a SOLD domain, and it may have forced them to email, call or do whatever they could to get in touch with the buyer to complete the sale.

you probably had renewal rights for a while after expiration.

you have the auth code. try to transfer it to godaddy.

My question is: was the domain so worthless loser that did not even deserve the payment of the renewal fee? If the domain was that worthless, then why bother in a forced reimbursement? The domain perhaps sold for something around mid xx so you did not bother on renew it.
I think it was your responsibility to renew it unless there is a clear policy on the site that if in x days you have not been asked the domain you can keep it. With no such a policy It was more than logical the owner would claim the domain soon or later.

Yes, domain is not worthy for me to renew. Also I don't have a right to sell a domain that has already sold. Its a policy of every domain selling platform. You can't sell a domain at 2 places.

Yes. I think I made a mistake by not contacting godaddy when it's close to expire so that they can urge the buyer to transfer the domain. I think I should take it as a lesson and continue

If you real the case full that you would understand I did not have buyers info to push. Godaddy does not handle the transfers of domain sales where the domain is not registered with them.

With any move you make on Godaddy, you receive an email or two or 10 as confirmation. Please don't allow whoever decided to be high and mighty for the day bully you into refunding a transaction when the buyer has violated GoDaddy Terms of Service.

Whatever the buyer's excuse is, he works for a business just like GoDaddy and is not only gaming the system, he is scamming you.

5. PROVISIONS SPECIFIC TO PURCHASING/BIDDING ON DOMAIN NAMES

As a Buyer, you are obligated to complete the transaction if you purchase the domain name through a fixed price, Buy Now format, or if you are the highest bidder at the end of an auction and your bid meets or exceeds the minimum bid or reserve price. Should you fail to complete the transaction for any reason (including, but not limited to, failing to pay the purchase price if you purchase the domain name through a fixed price, Buy Now format, or if you are the highest bidder at the end of an auction and your bid meets or exceeds the minimum bid or reserve price), Go Daddy reserves the right to (i) charge you a fee or (ii) terminate your membership with Go Daddy Auctions (as determined by Go Daddy in it sole and absolute discretion).By initiating and sending payments through the Services, you appoint Go Daddy as your agent to hold the funds on your behalf and transfer them to the recipient that you designate. Once you send payment, Go Daddy will hold those funds as your agent for a prescribed period of time based on the type of transaction, at which time Go Daddy will release the funds to Seller. At no time will you be able to withdraw those funds or send the funds to another recipient unless the initial transaction is cancelled.

The above is edited for brevity. The transaction is non-refundable, for one. For two, you deserve an apology, however, the scammer is innocent until proven guilty. Offer to fax records of all communications between you/GD support and you/buyer as proof.

Also, when you have a major problem, never speak to the first person on the phone. They will be eager to help but don't talk to them. They already know what the issue is because of notes on your account and will give you the same canned responses.

Always ask for the name of the dept manager on duty, then ask to speak with that person. The manager will then followup via email. I think managers leave about 4-5pm MST.

you should have notified godaddy about this, then they would be held responsible.
for now from what you said it looks like godaddy are responsible before the buyer that they paid you without verifying the transfer to the buyer that's why they want this money from you
