These are in no particular order.

From what I understand, Adam still owes north of $33,000 to previous customers and business partners. As I receive more information, I will update this figure.

I dont know what is "untruths" but I can an say true that all good domains is taken and only $hit like .xyz available and that is the reason of such long threads.

I have gone to extreme measures to get my money that I now have even offered to sell him NicheKeywords.com for $1600 after he registered SEORankKeywords.com 2 weeks ago.

I being in bi-weekly contact with him for the last 4 months and nothing ever materializes. I was even promised more when asked for a refund. In fact we had a live call on the phone after that.

I am just ready to cut my loses and move on. Yesterday we communicated again after some chatter I sent him an Escrow link to purchase the domain NicheKeywords.com and I stated I would call it a truce with FanExperiencePackage.com . I am web Developer / Old School SEO guy. I mean, I ranked #3 for Tampa Web Design, alone and the other two where Million dollar companies. Not the biggest feat, I know, but none the less.
So I have somewhat of a knack for building website and doing marketing for more than 10 years. Why then would I have him develop this website? To be connected, and promises of making lots of $$$$$$.

So you all think I should cut my loses by:

I highly doubt that..all good domains are taken ... I find good .com domain everday

I had an experience on DNF with Adam back in 2011 and was not happy with how he responded so I blogged about it to warn others. The short of it is someone intentionally won an auction of my domain without the intent of paying (just to keep someone else from buying it). They did not pay, then they contacted me to try to buy it for a fraction of what the auction ended at. I informed Adam of this and asked him to ban this member since the guy was clearly a scumbag and not someone you should want around a good forum and Adam refused to. I lost whatever respect I had for him then and never have had any dealings with him since then. It's a small case, but it shows he put his agenda before the welfare of the hundreds/thousands of members on DNF.

The "written contracts" are in our email inbox. And yes, emails do now stand up in court as written contracts. But small claims court does cost more then some people can afford to pay. It's unfortunate that you can't afford to fight for yourself legally. So you have to rely on and hope someone "bigger than you" will start a blog or thread like this to get the ball rolling, in the hopes that Adam will do the right thing and pay back what's owed.

Emails do stand up in court but only if they meet the material needs of the contract. I doubt your emails had specific terms related to your options in case of warranty, liability, failure to deliver, etc. etc. In other words - technically your email may be a contract but it's not a contract. A small business working professionally will be very clear - mostly to protect themselves from dissatisfied customers (for example someone who spends $3000 and expects the worlds greatest custom website end "free" maintenance or over-the-top-treat-me-like-Im-family extended warranties)

Small claims court (which wouldn't work in this case) is typically for damages under $5000 and depending on jurisdiction a lawyer may not even be allowed - but certainly not cost effective when looking for < $5000.

Basically - domainers need to stop short-cutting if they want quality.

And you even let the domain expire, FloridaLoan.com was picked up by me about an year back.

I picked up FloridaLoan.com when it expired and sold to someone else at Flippa about an year back.
The present website is that person's.

As a developer myself, this is simply not true, for 100$ to 1000$ you get a small or a crap big website or a good small one. By small I mean a wordpress or couple pages website. You really think big websites like this namepros or facebook for example would only cost 1000$ max to develop? Those huge websites takes hundreds/thousands of hours to code. There are other aspects than the "design" of a website, the code needs to be done properly for easier long-term maintenance and you will get what you pay.

Eh? It would have taking xenforo thousands of hours to develop their forum software, wouldn't take somebody long to install it on a domain, up a logo and change the hex codes.

That's like saying it would take thousands of hours to build the wordpress platform. It would, but it doesn't take thousands of hours to install a theme and fiddle with some theme settings.

To someone who owns tens of thousands of domains, $$$ is always more valuable than another keyword type domain.

I like your angle of trying to get your refund by offering a domain based asset, so it helps the other party feel fruitful about the refund, since you probably have a low cost, and little use for the domain, that is probably your best bet, or maybe ask for a trade from his portfolio instead, a domain that has a wholesale value equal to your refund.

Shouldn't this post be made a bit more private? Or does no one here seem to care about the feelings of kids? In a world of online bullying can you imagine how it might be for them?? Am I the only one going to mention that? From what I see this post coincides too closely with the domain conference in Florida ending and "so called" awards being handed out.
The domaining industry as a whole has a bad reputation yet when that is mentioned people go all hush hush about it with nothing further being mentioned.

I wouldn't be surprised if we spend more money and time scaling and enhancing XenForo than they spend developing it. Websites like NamePros can't run any old software and hardware they please; they receive too much traffic and can easily be overwhelmed by the slightest performance issue. We've had to rewrite significant portions of XenForo, and we have a large library of add-ons developed entirely in-house. There are rarely less than 10 servers running the website, and quite often more. We typically log and analyze about 3 GiB of diagnostic data per day to ensure everything is running smoothly using our proprietary monitoring system, and have several third-party monitoring systems that log and audit much more.
