I'm very close to buying a domain for low $XX,XXX (the most I've ever spent on a domain). This is a generic .com with no trademark violations. Before I go through with the deal I just want to know:

Are there any potential problems I should look out for?

Are there any specific forms I should fax to the seller?

Thanks in advance,
Minion

Yes

You can receive some very good advice here on Namepros.com . In order to do so, you need to give us a little more information. There are such things as trademark violations to consider. Or, possibly, you will be paying way too much for this domain name. Use a escrow company with a good reputation to buy this name. Better to pay a little extra,a nd be safe.
I am not saying to come right out, and say what the name is. It is just hard to help you, with what you have given so far.
I'm sure you will get a good response here, just keep watching, and try to answer some questions.

Good luck

Frank

If you care to , pm me the name, Ill tell you if its a good buy and check whois history etc. It's safe to say you can trust me.

If it was a bad buy, my guess is that he would have said no before the xx,xxx stage. He is just trying to be cautious before he commits all that money.

If you're already in the final steps of negotiations, share the name. Otherwise you can PM it to me as well. We'll let you know if its a good buy.

- Beware, generics have been lost in UDRP cases

- Definitely use Escrow.com or Moniker Escrow

- Check if the name has been blacklisted or banned from SEs (verify past use in archive.org)

- Verify the owner is the actual owner

- A simple Sale & Purchase Agreeement should do, unless you want to get a lawyer to prepare an official doc.

Hope this helps.

Post in this thread the name after you finish the deal. I am curious to hear the name. :)

Everything Paddy said.

You can check WHOIS history at www.domaintools.com . You can see how long the current owner has held the name and ensure it's not been recently hijacked. It is a paid membership service, but worth it if you buy domains on a regular basis.

I would not reveal the name publicly until it's in your possession. You never know what snakes are watching, and some sellers are not above considering other offers even while in the middle of a deal with someone else.

Escrow.com :tu: Additional paper contracts are usually not necessary.

Im also in the same situation, a generic .com as well. But the only problem i have is how can i make sure there are totally no trademark violations? I did a search in http://www.uspto.gov/main/trademarks.htm and there are lots of live results. So does that means the domain suffers trademark problem? I don't really want to throw $XX,XXX down the drain.

Since this is a xx,xxx deal I think you must do this for sure.

Hard to answer that without knowing the domain. There are LIVE trademarks on the term? How generic is it? Purely descriptive terms are not supposed to be trademarkable, unless used arbitrarily for another industry. ('Chocolate' for cell phones, or 'Apple' for computers, etc)
