Somebody made an exact duplicate of my site and is now ranked higher than me and getting way more visitors.. Is there anything I can do about this?

My site is based on a large collection of layouts.

Here's a C&D letter you can send to the webmaster,

Dear [name of infringer]

It has come to my attention that you have made an unauthorized use of my copyrighted work entitled [name of work] (the "Work") in the preparation of a work derived therefrom. I have reserved all rights in the Work, which was first published in 1999 on http://www.mycompany.com, and I have registered the copyright.

Your work entitled [name of infringing work] and which appears on your web site at http://www.yourinfringing.com, is essentially identical to the Work and clearly used the Work as its basis. [Give few examples that illustrate direct copying and/or unfair use.]

You neither asked for nor received permission to use the Work as the basis for [name of infringing work] nor to make or distribute copies of it. Therefore, I believe you have willfully infringed my rights under 17 USC ยง101, et seq. and could be liable for statutory damages as high as $100,000.

I demand that you immediately cease the use and distribution of all infringing works derived from the Work, and all copies of it, and that you deliver to me all unused, undistributed copies of it, or destroy such copies immediately, and that you desist from this or any other infringement of my rights in the future. If I have not received an affirmative response from you by [date] indicating that you have fully complied with these requirements, I shall consider taking the full legal remedies available to rectify this situation.

If you send similar types of letters to the web host, they may opt to remove the offending site.

Damn scrapers, this has happened to me in the past... make sure to send the letters to their host as well, as RJ stated.

I have a question,

This letter would work only if I have copyrighted my site. What if I have not.

If I have a site and if I had a copyright, what if someone copied my forum categories, message boards etc.

I'd sue em for all they've got... I'd be sooo mad... but RJ's advice was worthy to follow :)

I don't know about America, but down here if you create something then you own the copyright from the start.

That's right. You, as the creator of "the Work" have a copyright on it. However, registering a legal national or international copyright just adds extra legal protection. Correct me if I'm wrong.

Look up their address from their whois entry and go kick their ass!

Or just do things legally...I think my way is more fun though...

I got question, If you build your own site, is that you own the copyright ? How bout if you get some inspiration from another site ?

Such as, if you built a domain name forum from the ground up but got the inspiration from another domain name forum? perfectly ok.

i think it's hard to do what you request, coz this is not a small world :)
maybe it's a luck if we find someone has stolen our works.

yeah that sucks to know...oh yeah, i know some stuff that can't be copied (or may be hard to copy)...these are flash websites :D well anyway i dont have time learning it ;)

Yeah, I would send the letter to the webhost and to the person who is in the whois information for the domain that copied your site. Odds are that the person who owns the domain wont care because they took it in the first place but I am sure the host will.

Check the source code and just skim over it, see where he set breaks at and stuff like that

this depend on your flash, but as the decompilation progs appear, i think it's not too hard to modify any flash now *proved* :)
