I searched the TM database, and found 0 conflicts.

Could I still be sued? Legal action taken against me? I'm pretty nervous right now - can't decide whether I've got a few nice nuggets or garbage! lol

Just because a TM is not registered with USPTO, does not mean they do not have TM rights stemming from use.

That still doesn't mean he can't use the domains for a legitimate purpose even associated with the brand. He has only registered the name he has not admitted yet to any usage. I would give him benefit of the doubt and like to see him make some cool pages concerning information regarding these brands and offer them as a free non-commercial purpose.

He didn't say he reg the brand. He said, "based around something new that the U.S. government is developing". For all we know the item could be a LaserStunGun which will be branded as "whatever". If he reg laserstungun, then it's a generic.

From my limited experience the name Big Dag was given by the company, not the government. They could certainly TM this for civilian use.

A quick search shows a Big Dog motorcycle brand and Big Dogs clothing as well.

I think you can avoid problems but I am not sure that you will be able to prosper much from this unless they commercialize the product and license dealerships.

I agree, these are certain limitations of fair usage.

He has only registered the name he has not admitted yet to any usage.

It what wasn't said, like "I what do create a forum or discussion site..." along wiht registering "several", that shows trying to capture traffic form several different sources (traffic is only important if you are looking to make some $$$) based on something someone else is developing.

^^^^ and that would be ther porper way to handle something like this, also, note the "free non-commercial" part.

But is all honesty, I am sure there is another word in the domain along with "bigdog" that could hurt the OP.
