Sedo commission penalty still possible for cancelled transfer?

Ok not a cool thing to have happened, but for one reason or other i did not proceed with a domain transfer after "agreeing" to do so. At the time (over 2 years ago) i did not get a bill for, just a message at time of transfer cancellation saying that sedo "could" charge the commission to me. It does not look like they did but...

does anyone know if Sedo could take a penalty (their commison) out of a *future* earnings for a domain sale with them?

They probably will. I know eBay will usually not do much until you make another sale then bam they make you pay.

yeah i can see the agreement states they can "collect" the fee, but would they after its been so long?
anyone else have experience of this happening please?

i have a domain that needs escrow,
maybe i should just use escrow.com instead or is there any other decent escrow service (and one that accepts paypal payouts would be best)?
