Is it illegal to have background music on a site? like il take a song from a cd and embed it on a site, is it legal?

Depends if the sound is copyrighted. Most are, so to answer your questions, yes it would be illegal. You would need a license or waiver to play the song.

But i think if you buy the real song and its not copywrited
then you can definately play the song.BUt make sure
if its copywrited or not before you put the song on your site.

That's not true. If you are broadcasting a song that's very different than personal play. Believe it or not but bars that play music have to pay royalties too. You can't own a bar and simply pop in a CD player and do whatever you want. You will be sued and fast. They have very strong and powerful lawyers. If the site is non-commercial that may be different situation..such as a myspace or blog. But if you are making money and using music as part of it...even for ambience then you are profiting.
