Purchased a domain with lots of redirected traffic, can I request the refund? (SEDO)

Hi,

I have just purchased a domain from SEDO, which shows decent typein traffic.
However, I found the seller redirected many traffic from other traffic domains to the name I purchased.

Here comes another question, does SEDO count the redirected traffic?

I have paid but the seller hasn't pushed the name to SEDO yet. For such situation, can I apply for refund and cancel the deal? I can show many domains that being redirected to that name. I checked SEDO's TOS and the contract, but didn't find anything regarding such issue. To be honest, I paid for the traffic so this is totally unacceptable but if SEDO sells domain only for the domain itself, I would accept it and see it as a lesson rather than a frustration.

Honestly, I hate to say this. But its one of those things - Buyer Beware. Always gotta do your own homework. I doubt Sedo will refund you.

Did you make the assumption that Sedo traffic stats are from typein traffic? Sorry but that's not what it says...at sedo the traffic shown is "Unique Visitors per month".

Sedo User Agreement rev 23-Oct-2006:

5.1.3.4. Legal Relationship as Between Sedo, Buyer and Seller
Sedo is neither owner of the Domains listed in the Domain Marketplace and/or Auction nor does it have any influence or control on the business conducted among Users of the Domain Marketplace and/or Auction. The responsibility for the content of Domain listings, including the accuracy of any statistics, whether measured and displayed by Sedo or otherwise, lies exclusively with the respective Sellers, Buyers, and users.

5.2.4. Penalties for Failing to Perform Obligations
Sedo reserves the right to cancel the domain transfer and escrow transaction if one of the parties to the purchase and sale agreement fails to fulfil its obligation to cooperate in the transfer process after two (2) requests are made by Sedo via the email addresses provided in his/her user account ("Failed Transfer").
In the case of a Failed Transfer, Sedo reserves the right to collect any applicable commission fee from that party who has violated his/her obligation to cooperate. Furthermore, any claims for damage compensation or contractual performance can be asserted by the non-breaching party against that party which violates his/her obligation to cooperate.

i suggest u call sedo directly to ask if u can get a refund..if not then take it as a lesson to be learned

well, at the very least it would give sedo the heads up on this guy, and maybe help other domainers avoid such scams

Other than reminding you of the problem, what would it hurt to try to get your money back?

As you describe it it is a clear case of mis-representation, if not fraud.

I once won the auction of a domain that had fake traffic, but i have not sent the money to Sedo and luckily i was able to cancel the deal.

I would contact them asap and refuse to pay - sounds like a Pump & Dump scam.
