Depends how it's used. If it references the "penthouse" magazine or brand directly then yes, it's a trademark issue. If it's a site about penthouse condos, etc then no.

Same would be for Playboy. If referencing the magazines then it's a TM issue . But what about a site for guys that pick up lots of women and are "playboys". the term Playboy was around before the magazine but it would depend how it's used.

Same would be for any word with both a TM and other meaning like "apple".

Not that you didn't already know this but when you see a bunch of examples in a row it makes it clearer that 'context is everything'.

and... Apple is allowed to trademark apple?? Yup! All depends on if others try use it to capitalize on your 'market' for the said TM.

If you park it, I'd set your keywords to penthouse condos, homes, apartments, rentals, etc. As long as you use it for related to it's meaning type of content, and not 'Penthouse' type of content, "all should be quiet on the WIPO front." Nice name.

I have penthouseplace.com, I'm going to place it with AFD later - but I doubt they'll accept it, because it has the possibility of being considered a trademark and/or adult.

and AFD is Not lenient.
