Hello folks,

Heres a nice unique situation here: Are domain Hacks "TM infringement"?

I recently registered the lovely domain Oakland(dot)As. I use to be an Oakland A's fan (when i lived in the bay area).

Now this makes for an interesting Scenario. As you may have known .as is a legitimate ccTLD extention (American Samoa). Now without the .As, they keyword is "Oakland" a purely generic keyword (a city).

Anyone know of any UDRPS relating to domain hacks?

Your hurting your own cause by announcing such a thing exists as "domain hacks". Either you own Oakland dot american somoan or you own the hacked domain of Oakland.A's.

I laugh at people that are into these so-called domain hacks. Ridiculous.

So have you ever used the domain as a true fansite (as opposed to a fake one to try to make money)? Right now you have links up (PPC) which does not create interest in the domain (that is usually the ruling). By your own admitance, this is confusingly similar to a TM.... that is the first two parts of the criteria of a UDRP :)

Yes, it is confusingly similar to the TM (if that is what you are asking).

Of course the PPC links have nothing to do with the Oakland A's. It has to do with the city Oakland. "Confusingly similar", in what regards.

Are you supposed to look at extention when make WIPO cases?

Anyone have any examples?

That is my question. Of course its the "intention" of the site. I am parking the page showing ads about the city of Oakland.

In my opinion it's okay if you have an A's fansite, but not okay if you have a parked/ppc page.

You look at what the complainant makes the case about. In this case,the full domain looks like the property of MLB.

We all see what you are doing, but it seems to be all legal. Anyone ever been to Oakland American Somoa?
