Hi there, I was buying a domain, but it seems there's an issue.

The domain was listed on Sedo, and I assumed that it would be fine, so have already paid for the web design and logo, and would prefer to go ahead with it, I really like the domain, and it's not overly expensive.

The domain was previously used, and has one or two complaints online regarding it, but I'm not bothered. It was owned by two people, who were business partners, however they had a not so amicable split.

Person A is the person who has the domain in his account, he's friendly and happy to sell it to me, and can do a internal transfer with the registrar.

Person B is the person whose details are in the whois and with Nominet, and my sources show that he is unresponsive and not likely to co-operate.

Person A still runs the original business, Person B is no longer a part of it. No documents were made during the split regarding ownership of the domain.

Currently, the domain is parked with Sedo, and hasn't been used in 2-3 years. I plan to fully develop it, and merge an existing site into it, so it's not like I'm just planning to sit on it.

I have more funds than person B, and can afford lawyers, he likely can't. (Although obviously, I'd prefer not to rack up hundreds/thousands in legal bills.)

Is there any way to continue from here? I've attempted to make contact with person B to come to a compensation arragement, but I've received no response, and the Sedo sale was automatically closed due to him not responding. I've phoned up Nominet, and they suggested letting it drop, then repurchasing, which isn't my favourite idea, as it would result in a lot of downtime during the redemption period etc.

Person A is happy to go with an agreement where funds are put in escrow, the domain is transferred internally in the registrar's system, and funds are released once my name's on Nominet's records.

Is there any way I can proceed from here? The domain's been parked for years, and the account with the registrar is in the name of the company, which as I mentioned before, A is still the managing director of.

Try post a letter to Partner B. You should be able to get his address from Partner A. You might be better off not letting him know A has already agreed to the sale .... that might just pi$$ him off the deal!

... but why would he Partner B want to sell the domain name if he is still running the original business? You risk losing your money if you buy from Partner A without Partner B's permission, seeing as his details are the ones with Nominet.
