Hello,

I received an email today from namejet telling that they had a server time issue this weekend, and that all the auction will be restarted.

I won 2 domains this weekend and I already paid for those 2 domains. They are now in my networksolution account. Can they go to my account and remove it? Any other people received this email?

I would imagine their TOS allows them to do just about anything. (As a well written TOS should)

I received this email too. But Only for auction on October 26 will be affected. I won 1 domain on 27 and it still on my account untill now.

You mean you didn't know? NameJet's TOS is about 50 pages of legal mumbo-jumbo, then page 51 is simply "Pages 1-50 are null and void. We can do anything we want. You have no recourse. Kthxbye" :p

Terms....terms....terms......does not make it right.

They should honor the auction even if they had server problems......that is just greed at work.

Auction houses and registrars are turning into professional thieves..... and although this situation might not be thievery, it sure would feel like it to me if I had won.

Why is it that this keeps happening all the time now with auctions? It was not an issue in previous years......so it really makes you second guess these auction houses.

TDNAM is the only one I truly trust anymore.

I got email for October 26th auctions to re-open. However I only won a few on Oct 27, not Oct 26. Why am I still receiving any email?

they don't let you push names for 42 days either. also if you are the #2 bidder and the #1 defaults they start a public auction at the last bid price-- even though it was a private auction originally with a limited amount of bidders.

As a result of a server time issue on 10/26/2008, some auctions on NameJet closed without the active participation of all current bidders who intended to bid due to the false impression that the system was no longer accepting bids. Based on the response of numerous customers who brought this system error to our attention and indicated that they would have continued to bid if they were not under the impression that the auction had ended, NameJet decided to reopen and restart those auctions. This was an isolated incident and we do not expect that it will happen again on our platform. Can you cite the specific TOS where it reads that you can repo the buyer's domain after he becomes the registrant? Moving along, if your decision was certainly not financially motivated, then you should have no problem giving the surplus money you realized from the subsequent auction to the winner of the first auction. Actions speak louder than words here.

Namejet gets a thumbs up for responding here.

Namejet gets a thumbs down for coming up with a resolution that doesn't resolve the issue with first winner. The do-over in no way comforts the original winners. Compensation should be considered.

So they can't claim the seller is getting shafted. They are the seller. It's their system that didn't function accordingly. Namejet...if you read this. Seriously reconsider how you are dealing with this.

Your well worded response here doesn't gloss over the fact you're shafting the winners. Your TOS I am sure allows for you to negate bids for various reasons. This is one of those times. No bidder that lost out is going to be that angry imho. They can't be angry because they were never told they had a genuine bid placed. So they just lost out.

Days later you realize this error and decide shafting the winners was the best move? It's obvious it was the most profitable move and nothing else. If you have to take a hit on a few auctions because your system was inadequate then so be it. Fire your software engineers if you want.

So why are you giving them the impression they can bid now that the auction is over? You should fess up the system error. Say the domains are contracted for sale (some are pushed) and you have fixed the error so it doesn't occur again. What's a bigger error is creating a sedo-like situation where bidders won't trust winning. Heck you even want domain back that are paid for and pushed. That's a huge step over a line imho. What are you going to do if these people do not give up the domain? Legally the contract is completed. Are you going to cancel accounts? Threaten lawsuits? How about convince netsol to transfer them illegally to you?

Really...don't make a mess bigger just to make a few more bucks. That's really what's going on here.

Take the loss Namejet. Look at the reputation that ireit maintained vs sedo for it's mobi blunder.

You can go either way too. Take the high road and stand by the original buyer instead of looking at your bottom line. Reputation is everything.

Be Careful

The more online auction sites operate with apparent impunity, the more likely state and federal legislatures will pass laws to address these issues. State Civil Codes covering auctions and auction houses can be amended.

Maybe it's time beljf123 contacts his state attorney's about what Namejet is doing. He has won the auction and has possession.

Just to let you know the domains have been removed from my network solution account, my credit card was refunded, and are now back to auction.

In my opinion, this is a major breach in the network solution account security and privacy. I did not know their "partners" can have access to my account.

As I am french canadian, I think it will be more complicated and expensive to contact an attorney about that. And, I don't have the time and the money to go fight with this kind of company. :(
