it all depends on the user license agreement.

if it says you can distribute the file (for free), then yes it is fine, otherwise, no.

as for the script, you'd probably need a custom one

Scripts such as scripts released under GPL for example you can redistribute with no problem as this is taken care of within the licence. So Albino is indeed correct, you would need to see what type of licence the program/script is distributed under before you could go ahead.

Scripts that allow you to run such a service should be easy to find on places such as hotscripts. Remember however if you plan on serving a lot of files then it will be bandwidth intensive.

i want to put trials also... i dont want to put illegal software... my question was if it is legal to 'take' the trials, freewares and sharewares from download.com and put them to my site in the same conditions... from my point of view i think that is legal.. because all that is on download.com is legal... i was wondering if they have some agreement with some software developers that their respective programs could be found only on their site... if not so.. i think that there is no problem if for example u will download the trial version of a certain software from my site and not from download.com

Couldn't you just link to the download page on their website?

As stated, if it's freeware and the user agreement when you download specifically says you may re-distribute this software, then its legal ^^
