eMortgage.jp Do I have a TM trouble?

I posted this issue in NameDiscussion board, people gave me very good advice.But I am Still not sure about the TM issue.
I will take care of that.Also, I need to know clearly whether it is a trouble.

eMortgage is a company in California.their trademark is e-Mortgage.
eMortgage.ca is another company in Canada, their trademark is eMortgage.ca
eMortgage.co.nz
eMortgage.com.au has no trademark.

Who will sue me? How to sue me?
I think they should negotiate together,decide who is the first and stand in a line, come to Japan to sue me.
The smallest case fee in Japan is 3000$.
Will they really sue me？Will they win the case?

Trademark and Trademark are not the same.

If I open a corner store called SuperStore, and trademark it, someone in another city can also operate a corner store called SuperStore and not infringe my trademark.

If an eMortgage company offers service worldwide, then there's potential TM issue.
Otherwise, don't worry.
