Remember though, if a domain is already in PENDING DELETE status at the registry when you place your order for it at SnapNames, it is too late. The name will not flow automatically to us but will instead drop and be subject to the efforts of anyone and everyone trying to register it.

That's true for all registrars. If the domain actually enters "PENDINGDELETE" status, it will drop and be up for grab by all the drop catchers.

How the exclusive contracts work- if there is a backorder of the domain at SnapNames ,the registrar takes control of the domain and puts it up for auction without actually deleting them. When you win them at Snapnames, you'll notice the creation date of the domain remains the same as it was for the original registrant.

As I understand it, if a Dotster name expires and no backorders are placed for it at SnapNames, Dotster will eventually put the name into the regular RGP process (redemption period, then pendingdelete) causing the name to drop normally. So if you don't order it in time and it enters pendingdelete, like Kjel says it's too late.
