In December 2007, the auDA Board approved a recommendation from the 2007 Names Policy Panel that the Transfers (Change of Registrant) Policy be relaxed to allow a registrant to transfer their domain name licence to another eligible entity, for any reason.

The auDA Board has approved an implementation plan for the new transfers policy. Key features of the new policy are as follows:

* it will not be allowable to register a domain name for the sole purpose of resale or transfer to a third party
* registrants will not be able to transfer their domain name for the first 6 months after the initial registration (this does not apply to domain names that have been renewed or previously transferred)
* after 6 months, registrants will be able to offer their domain name for sale/transfer by any means (eg. by listing the domain name for sale on a domain brokerage website, advertising the domain name for sale in a newspaper, or contacting a prospective buyer directly)
* registrant transfers will be processed by the registrar of record using a standard transfer form, and the registrar may charge a transfer fee
* parties to a transfer will be asked to disclose the sale method and price, on a voluntary and confidential basis, so that auDA may collect aggregated statistical data to improve access to market information for buyers and sellers.

auDA will consult further with AusRegistry and accredited registrars on the technical aspects of implementation.

auDA has not yet finalised the implementation timetable, but anticipates that the new policy will be introduced in mid-2008.

In the meantime, the current Transfers (Change of Registrant) Policy (2004-03) continues to apply and auDA will continue to investigate complaints about transfers that breach this policy.

I think its great actually that they still have some restrictions on a 6 month lapse before selling the domains, which will help to prevent the time big cybersquatters taking over, plus i believe you still need to have an ABN or ACN.

I'm looking forward to see how this all pans out, this was always a problem of mine knowing that i have some great au developed domains, yet prevented from offloading or selling them, hopefully this will fix this and we can all openly sell our au websites to other Australian companies.

always could transfer names but was difficult
Now it will be easier ,but still has the prohibition on foriegn ownership

Actually I have known of this for several months (that it was coming)
that is why I have been buying a lot of .com.au's

The other Issue that has been clarified is domain PARKING is now accepted legal use for aussie names. (Parked.com.au is to be developed for this)

I see possible legal problems...

But this is defiantly good news for the Australian domainers.

What legal Problems
Parked.com (or any other Parked.gTLD for that matter) has no legal Claim (TM or otherwise) to the name Parked.com.au
(auDA rules categorically state that)
2.3 There is no hierarchy of rights in the DNS. For example, a registered trade mark does not confer any better entitlement to a domain name than a registered business name. Domain name licences are allocated on a โ€˜first come, first servedโ€™ basis. Provided the relevant eligibility rules are satisfied, the first registrant to apply for a particular domain name will be permitted to license it.
SCHEDULE A

ELIGIBILITY AND ALLOCATION RULES FOR ALL OPEN 2LDS

First come, first served
1. Domain name licences are allocated on a โ€˜first come, first servedโ€™ basis. It is not possible to pre-register or otherwise reserve a domain name.

Registrants must be Australian
2. Domain name licences may only be allocated to a registrant who is Australian, as defined under the eligibility and allocation rules for each 2LD.

Composition of domain names
3. Domain names must:

a) be at least 2 characters long;

b) contain only letters (a-z), numbers (0-9) and hyphens (-), or a combination of these;

c) start and end with a number or a letter, not a hyphen; and

d) not contain hyphens in the third and fourth position (eg. ab--cd.com.au).

Domain name licence renewal period
4. The domain name licence period is fixed at 2 years. It is not possible to license a domain name for a shorter or longer period.

5. Renewal of a domain name licence at the end of the 2 year period is dependent on the registrant continuing to meet the eligibility and allocation rules for the relevant 2LD.

Number of domain names
6. There is no restriction on the number of domain names that may be licensed by a registrant.

Fantastic news. Can't wait for .com.au to really pick up.

BTW (and posted this somewhere else as well) Michael Gilmour offer a great .com.au registration discount deal, approx $US 25 for 2 years I think, on his blog.

I`m interested in any .com.au with traffic

On another note, before to jump on any LLL countdown, I would first ask to AUDA if and when they plan to release the second level otherwise you just may end up buying rubbish (and I remember in 2006 there were LL.com.au available at reg fee but I did not take them because of the third level

$50 AUD (average price for 2 years registration) is not expensive compared to a lot of other ccTLD's

auDA has stated emphatically that .AU will never be released.

I disagree:

Italy,Germany,France,India,Canada,Usa,UK, and lots of other countries charge less than $10 yearly for their ccTlds.

Australia & New Zealand, as developed countries as they are, should charge less.

And I remember a questionnaire last year on the AUDA website asking opinions about releasing the second level.

Yes AU could be cheaper ,but again a lot countries charge more
including a lot of ccTLD's that domainers seem to still buy in reasonably large numbers
.TV for example


auDA policy review report documents have statements regarding the .AU cctld

Thanks for the info.

Italian, I wouldn't pin hopes on a second level .au domain. .com.au is too successful and successful online businesses with .com.au always vote against the idea when it is brought up. Rebranding is too expensive.
