One of the most common pieces of advice you hear in the domain industry is, "don't register a Trademark."
Or you hear, "I don't register or own Trademarked domains."
Yeah right.
Strangely, according to the Harvard Law Review, citing the New York Times:
"almost every naturally occurring word has been claimed."
Knowing that, there is a very good chance you do in fact own a "Trademarked" domain. So what gives?
Again, according to the Harvard Law Review:
"Trademark applicants are increasingly resorting to what we term “parallel registrations.” Two firms can use exactly the same mark provided that their uses would not confuse consumers as to source (for example, DELTA for faucets and DELTA for airlines)."
