Why losing a UDRP can hurt you

Interesting post over at The Domains about how someone lost an arguably-"safe" LLLL in a UDRP because of their past history of "abusive registrations"

“”The question remains whether the Domain Name was registered in bad faith”

“The Respondent has a long track record of engaging in abusive registrations.”

“”The Respondent’s past conduct is taken into consideration, the evidence as to the Respondent’s motives for registration becomes overwhelming. The Domain Name can then be seen simply as one of a long line of registrations by the Respondent seeking to take advantage of the reputation of the marks of others.”"”

Interesting read, but if look at these last lines -- "It is not an allegation that is made in the Complaint and it is possible to reach a decision in this case on the balance of probabilities in the Complainant’s favour without any reliance on this conduct."

They are saying that they would have most likely reached this decision even without a history of bad conduct.

Interesting read nonetheless.

True , That fact makes it much less dramatic ,
