Hey Folks

Another UDRP case where he complainant is trying their luck. I hope they lose their case and are ordered to pay for all Mrs Jello's legal expenses as well as an additional $100k for deformation of character or something like that..lol

========================================

Company that owns Loading.es wants Loading.com…without paying for it.

A Spanish webhosting company has filed a UDRP against the dictionary domain name Loading.com.

Grupo Loading Systems S.L. operates a webhosting company at Loading.es.

Loading.com is owned by Mrs Jello, LLC, the late Igal Lichtman’s company.

According to historical whois records, Mrs Jello acquired the domain name in 2009.

Although no recent screenshots of the domain have been captured by Archive.org or Screenshots.com, the most recent ones show ads related to front-loading washing machines, truck loans and loading software.

The domain name does not currently resolve.

Just like thankyou vs thanks. Both super generic terms. But one company claimed not to used "thanks" because they had trademark the word "thankyou"

One member here on NP said trademark people approved the word "thankyou" to be trademark because of the word "And"

But Citigroup was suing for the "thanks" AT&T.

Citigroup should be suing for the word "And" this is the word they were approved of..sure lots of merits there ;)

I think all these companies that try to place a TM on any English dictionary words should be told to piss off.

It should never be allowed, if they choose to name their brand with a word from the English dictionary then they should accept the consequences of that....

Even companies like Apple should never be allowed to TM the word "Apple". Unfortunately in the current "system/matrix" money talks...

Agreed! I say unless its a result of your own creative endeavors, you shouldn't be allowed to trademark any word.

AWESOME or AMAZING or whatever ..sooner or later the whole English language will be TM'd ..... hahaha can you imagine. I mean lets say some plonker with loTs of money goes and decides right now to go and trademark the 1000 most popular words used in the English language... lol

Need to put truly reasonable and fair lawyers and attorneys in the trademark industries. And people in the court who handles trademark dispute should held trademark people accountable.

Problem is "fair lawyers and attorneys" are harder to find than unicorns. :)

Regardless if you is a billionaire.whatever. If I was a lawyer i would not allow this kind of transaction; because it's the right thing to do. And it's said by me.

The Apple TM story is worth a read. Check WIKI : It starts with the Beatles.

The domain Loading.es should be taken from that webhost company and given to Mrs. Jello. imo

It's clear as day that the owners of Loading.es want to steal Loading.com. They should be jailed.
