Valhallan LLC, the Complainant, filed a complaint against Casey Strattan, the Respondent, regarding the domain name Vallhallan.com.

The Complainant alleged that they had established common law trademark rights in the United States for the mark “VALHALLAN” and that the Respondent had no rights or legitimate interests in the domain name. The Complainant further claimed that the domain name was registered and being used in bad faith. The Panel found that the Complainant did not provide sufficient evidence to support its common law trademark rights in the US, but it did have registered trademark rights in the United Kingdom for the mark “VALHALLAN.” The Panel concluded that the domain name was confusingly similar to the Complainant’s trademark and that the Respondent had a legitimate interest in using the domain name for criticism purposes.
