Here is the stupid thing about this, why not just transfer the name and avoid the UDRP? Some will say, "hey if they want it, then let them pay 1500.00", but the problem with that is now there is an official judgement against the domain holder. So any future disputes, it can be used against him, especially if he tries the same thing. Then maybe a company will get POed and come after him under the Lanham Act to recover costs.

Well, when he received his UDRP papers, he could have done it then and the case would be terminated and his name is never mentioned in the UDRP.

I'm not entirely sure that would work - the company would have to request the transfer - and yet again, no evidence exists that they had.
Even still, a "pending" case still stays on the UDRP index and his name would still be there - the disposition would be the only thing that changed, the end result still being the same most likely.
Although yes, if the company had contacted him he certainly would have been better served just transferring instead of begging for the same relief as the complainant.

I guess some people insist on being stupid, especially if they aren't realistic.

This decision is an almost no-brainer.
