Hello everyone,

I was looking to purchase two very common words back to back. I did a trademark search on TESS and the words connected with an ampersand have a marked drawing code of typed drawing and and the type of mark is a service mark.

A good example of the two common words back to back I want would be
stocksoptions. And a company would have the words stocks&options.com with the aforementioned trademark filing.

How does one proceed in the process of determining if this would be a safe registration.? Any advice would be much appreciated.

If you're looking to sell the domain to the company, intend to profit off of it by using ads of competitors and/or start a similar organization to the one that holds a trademark, then you could run into some trouble.

Thanks.... It seems that many names fall into a

trademark gray area. Many of the ideas I get are cuttoff words, plurals , abbreviated forms of full words and terms that may be taken in one sequence but the reverse sequence is not taken. What do you recommend for these situations ? Case by case research is the best method,but how does one approach the situation after a trademark on a related form of your name is found, but there is still doubt. Retreat at the point of doubt? Study precedents?
Any thoughts appreciated.

If a term "confusingly similar" to your domain is a previous trademark, then I'd "retreat at the point of doubt," if you plan to use your domain in a similar (aforementioned) way to the use of the trademark.
