How does the resell of a domain that matches a trademark name effect the legal rights to it?

I am looking at a domain right now that a Chinese company has a TM on the same phrase in the USA. If I buy it in auction am I likely to get shot down?

It is expensive and I do not want to lose the cash. Thanks c

You very well could face a UDRP and lose the name completely, or civil action and lose much more. Will it happen for sure? Nobody knows other than the company that has the TM. Without knowing the name and your intended use, we're grasping at straws.

I agree with Allan. The answer is a definite "maybe". Without knowing a lot more about the situation, that is the best anybody could say.
