why dont either certain companies that dont want their tm to be violated make people aware they dont want them too...or why dont the registering companies stop it right from the start.
(dont get me wrong... im not against TM problem domains... i own a few) im just wondering why let people register them and THEN complain...
well i know a story that i heard last year that a teenager made "mikerosoft.com" for his personal site, and microsoft.com found it and offered $1 to buy it and the teenager said no, so microsoft sued him, its pretty sad that a multibillion dollar company does that to a teenager..
i agree... and i think that if a company doesnt have the sense to register surrounding domains...or domains that resemble their TM then its thir own fault. Its not right for microsoft ( for example ) to be able to have control of every word that looks or sounds like microsoft. m1cr0s0ft.com would that be considered a TM problem???
i mean im not trying to make a big thing of this... i just dont see why big companies can bully the little companies or single person business's just because they are more powerfull.
if a major company brings up a TM violation on me... i would offer to sell it to them at a decent, yet valuable price... if they have to go though legal problems then they will spend tons of money anyway. why not spend the money safely and just buy it off me? if they refuse... i would def just hand it over. They are powerfull... you will not win. If you do... you are God haha
yeah.... and thats what some people do... i guess if you know you are right about something... you draw the lines... but that doesnt aalways mean that you are right
but they dont have a right to take something away from me that i own, that would be like me sueing someone for having the name "Duane" it sounds the same but spelled different..
I have a three-word hyphenated, spelled correctly .com of a major cruise company.
Would it be best to try to sell it on the open market, or sell it to the comany that owns the TM? How would you go about it?
i wouldnt go directly to the cruise company...thats just asking for trouble... If you feel like you want to sell it... i dont think you should have any problem, but dont try selling it to the company unless you want to put up a fight IMO... You could always sell to someone with those intentions, and get almost as much wihtout haveing to go though legal risks..you understand?

I agree and I think it would be a cogent arguement in court. If a company like Microsoft with immense resources doesn't opt to register these similar/typo domains or ccTLD domains that are freely available to the public then they should have no right to sue. If a company like Microsoft wants to control a similar/typo domain that someone else is holding then they should pay the fair market value for the domain.
they will ask you what the domain is for sure Dwayne, but its not a bad idea... you just have to know the risks involved...
AmCy- im glad you agree.. it only makes sense... if a company is so worried about TM problems...then they should register the TM problem causing domains to iliminate a lot of fighting.

But there are situations where I would side with the big boys. For example, if someone registered a similar/typo name and uses that name for phishing or spamming, which as we all know is becoming a very serious problem these days.
I am also holding googlesearch.ws, googling.us and googled.ws but I am using them as simple search portals in partnership with Google, nothing nefarious. Makes a big difference, IMO.
yeah i totally agree... if the person or people that own the "illegal tmed domain" are hurting the tm'ed domain company...then that is wrong and yes the company should have every right. But if its causing no harm,,,then what good is it to pick on the littl guys?
