Some campanies leniant on copyrights?

I saw this site recently and noticed it's been around since 2000:

They also rank pretty high for at least a couple good terms, so I would think BMW has noticed them. I would also think they could easily get that domain but obviously haven't. Maybe BMW just seems to think this site doesn't hurt them?

I guess some companies just more leniant than others.

it depends on the company and depends on the site. if a competitor bought that domain then they might get sued. also, i don't see any ads on that site which would also help.

it doesn't seem to be used for commercial purposes, so it might be classified as a fan site. They do have a section selling used parts, but obviously in order to sell used parts for a specific make of car, you need to use the TM so people know what it's for. I think this would fall under Fair Use.
