    ELEPHANT.COM is forwarded to the complainant! Did they pay Adam the $1 million he was asking for? Anyone know more about this case?

    1. The Parties

    The Complainant is Admiral Insurance Services Limited, Cardiff, United Kingdom of Great Britain and Northern Ireland, represented by Hammonds, United Kingdom of Great Britain and Northern Ireland.

    The Respondent is Mr. Adam Dicker, Richmond Hill, Ontario, Canada, represented by Dr. John B. Berryhill, United States of America.


    8. Decision

    For all the foregoing reasons, the Complaint is denied.

    I believe they have paid up for this domain but I dont think the figure shall ever be released Im sure that it would have been subject to an NDA

    Interesting is that they still only brand as Elephant.co.uk here in the UK.

    Maybe they plan on growing outside of the UK and look at Europe and the US?

    Who knows?

    as it states in the WIPO case, Adam stated he would not sell for less then $1 million!

    For the record, I bought the domain becuse I like elephants, these days i like them even more. ;)

    I bought giraffes.com and worm.com and about 7 other animal names, only pig.com and elephant.com were sold so far.

    Elephant.co.uk is a major brand in the UK. They advertise on the TV, radio, newspapers, and billboards.

    The thing is, if just 10% of people mistakenly go to elephant.com, then they are losing 10% of their profits, and elephant.co.uk is a multi million pound business, so what in fact probably cost them $1 million was in fact a major investment by them.

    Adam, it is a pity you didn't like 'meerkats' as well - they have become HUGE here in the UK! Congrats on the win and the sale, they couldn't have happened to a nicer domainer.

    After National Geographic brought out their Meerkat Manor it would've probably had some major interest, but you never know lol

    Thank you, and I do like meercats, I own meercats.ca. I am a huge fan of animal planet.

    Funny thing is both pig and elephant offered money, then went to udrp and I won both of those UDRP's, then they came back with better offers.

    That is both hilarious and apalling, that companies would offer to buy something, and then when you don't like their offer the response is to attempt to force it from your hand. I hope you bled them like, well, like stuck pigs and elephants, respectively.

    I would've probably done the same...I can be quite reasonable and put a reasonable price up but as soon as someone starsts to try to bully me the gloves are off...no chance of them ever getting a sweet deal; if they want to play hardball with me then they had better dig far deeper than they had ever intended to.

    This case is a perfect answer to the other recent thread in this forum about "domain squatting".

    As stated in this WIPO decision, there must be "bad faith" involved to prove that i guy is simply cybersquatting the domain.

    If you can't prove there was bad faith, then start digging 1 million dollars from your wallet.

    I think the complainant's biggest mistake was revealing the true name of his institution. He could have just disguised himself as an animal shelter company and started bidding up the name in increments. But since he decided to come out as a bully, i'm not surprised the price tag suddenly rocketed up to the moon.

    How do you figure they are 'losing 10% of their profits'?

    Unless the owner sets up an identical site and business to confuse and steal customers they aren't going to lose anywhere near 100% of the business that mistakenly goes to the .com. They will type in the .com, see a parked page, maybe click a link or two and figure out that something is wrong and Google the name or whatever. Especially for something like an insurance company - suggesting they are losing that traffic as direct loss of profit, like its a drunken nightclub patron wandering in the wrong door, is ludicrous.
