Seller disappeared.

I won an auction on Sedo that had met reserve. A Sedo agent has been trying to get in contact with this person but since then, the seller has gone MIA and transferred the domain to another registrar under another name. (Possibly sold it to someone else).

What rights do I have here? I paid low $xx,xxx for this domain.

Sedo will refund my money, though... I want the domain. They suggested I take legal action as the seller is breaking contract.

Do I have ground to walk on to pursue this domain..?

Getting my money back is not a problem.

I am curious to know if anyone has had this happen to them and how if so, how they went about it..

Probably not worth the cost of the legal fight. Assuming both you and the seller reside in the same country it would be easier, but do you want your money tied up for possibly several years?

That is a situation I hope to never find my self in, if it were to happen to me though - I would have hunted him down like a dog. It's about reputation, if he was able to do this to you, then others will follow his lead. In order to reclaim the little dignity you have left, you must track him down.

Interesting question is if you won a legal battle over it, how could it be recovered if he did sell it to someone else in the meantime?

It sure can be recovered if it gets to the courts.. Getting to the courts would be tricky as we both reside in different countries and would most definitely cost a lot of money. He could of possibly sold it to someone else, but does not mean anything as you would pursue both of them.

Common practice to change registrar and registrant info when trying to escape selling.

It seems to be common amongst sellers. Although, what angered me, is that the seller set a reserve which was obviously met.

It really is too hard and too expensive to chase down the seller

You will need to take it on the chin I'm afraid, I really hate it when this happens

Very poor business advice IMO...there is no point in putting more effort into this. It has nothing to do with reputation. He will just change user name and find another market. Spending good money or time to got after him is a huge waste. and as other shave pointed out, the logistics of an international lawsuit for a relatively minor civil infraction are likely to cost more than you could recover. Winning a judgement is one thing, collecting damages is another. And really, what are your damages? Let it go.

In law its called jurisdiction!

Plus the fact you never lost funds only your dignity and bruised ego means little to anyone especially an attorney.

Just thank the universe you weren't ripped off!!

You can't do anything for that, happened to me couple of times.. You are lucky that you get your money back.

Once seller even clearly said that he changed his mind and doesn't want to sell for that price and asked more :) It happened in godaddy auction, usually auction platform suspends the account. That's it.

If it were me, I'd probably make a deal with one of the Dark Lords of the Universe. They could pull some strings and return the domain to its rightful owner.

It gives me an idea for a story about a domain name that was registered deep within the chasms of the GoDaddy server farm. It was different from all other domain names, because it could bestowe power upon its registrant. Dark power.

It had been lost for many millenia but one day it was registered by a farmer, on the farmer's wife's iphone, with a coupon code: CJC199.

At first nothing seemed wrong. But then the farmer began logging into his GoDaddy account, going to the domain manager, and staring at his domain name, for hours. Sometimes he would refer to it as his "precious". Then he began referring to himself as "we", like there was more than one of him.

The story would go on to describe how the domain name would be brought back to GoDaddy by a group of some of the most unlikely heros, and destroyed by the inner-most server, where it was created.

I think I'll call my story Lord of the Domains and maybe make a trilogy.

.... .com registry is in Virginia. Verisign doesn't care where you all are. They will do what a Virginia court tells them to do.
