In a last effort to find a solution to the current 3rd Sedo dotMobi Auction situation, the most difficult one in .mobi's short history, **** is opening a neutral and private space <Removed> forum to be accessed ONLY by those affected by the 3rd Sedo dotMobi Auction. By "affected", I mean those who received invoices, either at the time of the "crash" or after the "extension". The purpose of this private forum is to openly discuss the situation only with those who are "on the same boat" in order to reach a potential compromise that can be presented to mTLD for consideration. Since this potential resolutoin would be coming from most, if not all, of those actually affected by this situation, it will hopefully pave a way out of this mess.
To ensure the neutrality of Mobility, Andres the administrator of ***** will serve as a Moderator in these private discussions.
I ask that those participating be open-minded and reasonable throughout these discussions so that we can find a way to minimize the collective damage to those involved, and the collateral damage to .mobi.
Everyone participating in the Round Table needs to understand that
1) everyone else in this Round Table has a "legitimate" claim,
2) it is not possible to split a domain in half and award each half to 2 different people,
3) that any chance of success will depend on everyone being open-minded, reasonable, respectful, and willing to compromise, and 4) that most, if not all, of those affected need to be included and involved. If we can all accept that, then I think there is hope.
If such a compromise is reached, then we can present it to mTLD as an alternative to the pending lawsuits. Hopefully, that will be a win-win-win for all the stakeholders involved, especially the .mobi extension.
Believe it or not, there are people on both sides of the fence willing to compromise. That is all we need to take this first step.
In order to be granted access to this new Private Forum, you MUST have received a Sedo/mTLD invoice either at the time of the "crash" or after the "extension".
If you fit this criteria, let me know privately via PM so that I grant you access to the new private forum. Please contact me within 48 hours as time is of the essence. If you know of someone affected who might not see this message before then, please let them know as soon as possible.
Unless all participants agree otherwise at a later date, mTLD, Sedo, lawyers, ****** moderators, and anyone else who does not fit the specific criteria above will NOT be granted access to the Round Table. This is to ensure the privacy, focus, impartiality, and credibility of the discussions and resolution.
I have a lot of faith in the .mobi community and trust we can all come together to resolve this matter in a way that is satisfactory to everyone involved.
In light of the MTLD's new press release at http://dotmobi.typepad.com/dotmobi/2007/12/open-letter-to.html#more we see that the MTLD is finally realizing that they need to resolve this matter amicably between all "proclaimed" winners in the .mobi premium auction III unless once again this is a publicity stunt for them to look good and save face once again. Their claim in their new press release is that there was no transparency in the auction results and did not get reliable enough results to proclaim the rightful winner. This roundtable invites all the "proclaimed" winners to an open discussion or resolving this whole mess.
I have read the latest press release by the MTLD where Trey Harvin the MTLD CEO says:
"Under the circumstances, even if there were no disagreement about the point at which the auction should have ended, we can't be confident of identifying the highest bidder at that point with any reliability. To avoid prolonged disputes about rights to the domain names in the auction, we decided that the fairest course of action was to void the auction results altogether."
The idea behind the roundtable is to invite all the "winners" with the disputed names, and come up with a resolution for each one respectively. If this is done with all parties from both sides agreeing, I think that based on this new MTLD press release we all have exercised good faith in resolving these issues.
I suggest we have transparency on all the names including prices so then there can be no mistake about identifying the highest bidders and having credibility / reliability issues to avoid prolonged disputes. The MTLD clearly states that they are open to suggestions for resolution if their concerns are appeased. However, again I do not trust anything they say since they seem to flip flop on their statements and press releases and heard they even edit their blogs, removing any comment they see is detrimental to them. I hope this last time they are sincere about what they claim in their latest press release.
I hope this will get everyone talking and get this whole mess settled without having to go to court which will be inevitable unfortunately.
