POKER is a Trademark? and SEX?

I just checked up on the word POKER and here is a cut and paste of just one page of all the trademarks on it. There are another 3 pages . How can the word POKER be a trademark? Also SEX has various trademarks on it and words like sexappeal and sexworld and teensex and lots more.

I also checked on other generic words like
AIR,clever, bird,animal,beauty, essence,happy,create,wonderful,Ginseng and many more and all of them have various trademark rights on them. In fact there are hardly any generic words or combinations of generic words that do not have some trademark rights. How can this be? I understood that generic words cannot be trademarked generally and that some words can become so popular that they even become a general language term and therefore loose their trademark protection such as supposedly happened to ASPIRIN for instance.( Checked ASPIRIN and it has several trademarks on it) So that is nonsense and this aspirin excample often gets touted in trademark cases. And words like happy and joy and clever??? It in fact means that one can hardly register any name anymore as one will almost always be in some contravention of a trademark.

Yes this trademarks can be really not funny,

in Poland one company regged trademark "Torunskie Pierniki",

and it means "honey-cakes from Torun" ,
this is Torun local cooking specail and now a lot of bakers could not use this term to name it ...
I heard about many situations like this and I think that this is really unfair ...

trademarks are industry specific ...


for example if you have a trademark for "Apple" for PCs that doesn't mean that someone cannot open a company named apple for soaps and acquire a trademark for it for the Cosmetics and cleaning preparations class ...

also the fact that a word is generic does not mean that you cannot open a company with a generic term and apply for a trademark with that word for a specific industry ... it does NOT give you right towards the word (or its usage) , it just protects your brand against other brands in the same industry . The purpose of trademarks is protecting brands and avoiding consumer confusion (regarding the source of goods or services) .







PS: if you want to check two specific words in the uspto.gov search and not the occurence of each word seperately in trademarks , use quotes eg. "example phrase" (phrase search)
