I placed the domain at sedo to attract intrest to potential investors. I recieved an offer for 1500 but I do not wish to sell. What happen was I recieved a bid for 800 and I put a counter offer for 1500. I left a messege that I recieved higher offers at the time and the bidder accepted the 1500. My question is this... do I really HAVE to sell the domain if I don't want to? I never signed a contract and never said that other counter offers would never be made. I also never said that I would sell the domain if the buyer accepted a counter offer. I am new to sedo as I used to do business with afternic instead.

I would rather develop this domain with a potential developer/investor. It would be a much more rewarding job than what I have now. Any advice would be helpfull and If you can, email me your advice to my cell [email protected]

I will be away from the computer for a few days but I can check my messages from my cell phone.

OOOPPS! I believe that if you want to continue to be in good graces at SEDO, that you are obligated to sell it, per the offer/counter offer program. It does state that this is 'binding'. The other alternative is to never reply to anyone, change your whois info, buy a pair of 'Groucho Marx' glasses, and avoid any eye contact with people for five years! A little dramatic but you get it.

As per the reply above, if you pull out of the deal you risk being banned by Sedo. How likely that is depends how lazy Sedo are feeling, how big a customer you are and how much the buyer complains. Of course even if you are banned, there are potentially ways around that.

As for the legal side, and whether in theory you could be sued (highly unlikely to occur in practise): the contract is made in the jurisdiction of Munich, a city in Bavaria, a German state. I've no idea about Bavarian law or indeed the law of Germany in general. However, depending on the jurisdiction, not everything which people call a 'contract' is so legally. It wouldn't be legally binding under English and Welsh law for example.

I guess I'm not clear. Why did you put your counter offer at $1500 then - why didn't you just refuse their initial offer or counter at like $30,000? Why mention 1500 at all??

Non-selling seller

If your offer to transfer the Domain is accepted, you must complete the transaction with a ready, willing, and able buyer. Accepting an offer constitutes a legally binding agreement and should be given serious consideration. Once an offer has been accepted the buyer has a legal right they can seek to have enforced in a court of law. Sellers who refuse to complete an accepted transaction risk having their Sedo accounts cancelled.
