.tv Need Help/Advice Please: Bought a .tv on SEDO and...

So I bought a .tv name on Sedo for $300.00. The seller accepted the offer and SEDO took my money. The guy was suppose to transfer the domain to me and after a week I get an email from SEDO telling me that due to "Human Error" the seller backed out and SEDO was returning the money to me.

I was of course very upset about this and wrote a strong email to SEDO. Within 10 minutes I had a response and they asked me to call in.

So I called SEDO and they said they spoke to the seller and he was claiming he accidentally clicked twice on the agreement button. SEDO doesn't buy it and I don't buy it either. SEDO clearly agrees with me and says that I do have a legally binding contract and I have a copy of that contract.

I sent an email to the seller and will give him a day to respond.

Has anyone outhere gone through something similar? Any advice? If I hire one of the domain lawyers out there and win the case, does the seller pay the leagel fees?

Can I stop the seller from selling the name to someone else until this is setteled?

Seeing as Sedo doesnt believe it niether are they going to cancel this persons account? I doubt it but I'd request it of them...

Are they going to help you fight them or r u on your own basically?

They told me his account is under review and they do take these things very seriously.

Gentlemen,

I just sent searching a PM to Searching with details. I am glad the buyer is on this board so that I can find a way to communicate with them.

The "seller" was me, but I can assure you it was a transaction error on my part.

I know it sounds relatively silly, but I was up very late (I am in Cyprus right now), trying to put an end to some silly XXX SEDO offers I was getting on some of my names (triggering dozens of emails from Sedo to tell me that someone had bid $100 on my best domain name :) ). In these situations, I usually send back some XX,XXX or X,XXX counteroffers which in most case ends the discussion since it is usually not a serious buyer on the other side (I know I should go through and put reserves, but that is a whole other matter!).

With the name in question, I entered X,XXX and then proceeded to fill in the wrong section below while zoning out on the confirmations, etc. I know it sounds silly but I was 1/2 asleep at the time.

Searching, I would be happy to send you the email I sent to SEDO customer service within 10 *seconds* of clicking on Accept and realizing what I had done. I informed SEDO of the error and asked them to cancel the transaction, hoping this would correct the situation before it got to you.

You can check the timestamps on SEDO and my email. I can assure you that I did NOT receive a different offer in those 10 seconds. :)

As is typical with SEDO, they ignored me for 2-3 days before I got to them again and informed them again which is when I assume they told you.

I would be happy to pay any transaction fees to Searching incurred in his payment to/from SEDO as the ultimate error is mine and have already made that offer via PM.

Again, I apologize for the mistake. I can assure you again that I do not have another offer nor will you see the name change hands. I have been on many different sides of buying/selling transactions in NP and SEDO and I do not believe anyone has ever had any concerns before!

I have been in touch with Antonis, as soon as I saw it was him I quickly laid off. Us .tv brothers need to stay together! All for .tv and .tv for all!
