Hello.

A couple of weeks ago, my domain name proxilla.com got banned from Godaddy, and now they want me to pay $50 to get it back. It was banned because I was running a proxy site from my hosting account.. Can they do that?

Hosting services and domain services are 2 diffrent things. If I break the hosting TOS they take my domain name as well.. I think thats really ****** up.

If you broke the TOS, then there's nothing you can do. You agreed to them, although you may now think they're unfair.

well. you can always get a lawyer and take them to court. but unless the domain is worth at least $5k-$10k i wouldn't bother.

Check this thread out: http://www.namepros.com/showthread.php?t=156776 about GoDaddy doing the same thing with BT sites.

They said they will be restoring the said domains so hopefully they will do the same in your case if you demand for it.

5. NO UNLAWFUL CONDUCT OR IMPROPER USE.
As a condition of Your use of Go Daddy โ€™s Software and Services, You agree not to use them for any purpose that is unlawful or prohibited by these terms and conditions, and You agree to comply with any applicable local, state, federal and international laws, government rules or requirements. You agree You will not be entitled to a refund of any fees paid to Go Daddy if, for any reason, Go Daddy takes corrective action with respect to Your improper or illegal use of its Services.

Go Daddy reserves the right at all times to disclose any information as Go Daddy deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Go Daddy 's sole discretion.

If You have purchased Services, Go Daddy has no obligation to monitor Your use of the Services. Go Daddy reserves the right to review Your use of the Services and to cancel the Services in its sole discretion. Go Daddy reserves the right to terminate Your access to the Services at any time, without notice, for any reason whatsoever.

Go Daddy reserves the right to terminate Services if Your usage of the Services results in, or is the subject of, legal action or threatened legal action, against Go Daddy or any of its affiliates or partners, without consideration for whether such legal action or threatened legal action is eventually determined to be with or without merit. Go Daddy may review every account for excessive space and bandwidth utilization and to terminate or apply additional fees to those accounts that exceed allowed levels.

Go Daddy may also cancel Your use of the Services, after thirty (30) days, if You are using the Services in association with spam or morally objectionable activities. Morally objectionable activities will include, but not be limited to: activities designed to defame, embarrass, harm, abuse, threaten, slander or harass third parties; activities prohibited by the laws of the United States and/or foreign territories in which You conduct business; activities designed to encourage unlawful behavior by others, such as hate crimes, terrorism and child pornography; activities that are tortuous, vulgar, obscene, invasive of the privacy of a third party, racially, ethnically, or otherwise objectionable; activities designed to impersonate the identity of a third party; illegal access to other computers or networks (i.e., hacking); distribution of Internet viruses or similar destructive activities; and activities designed to harm minors in any way. In the event Go Daddy cancels Your Services during the first thirty (30) days after You purchase the Services, You will receive a refund of any fees paid to Go Daddy in connection with the Services being canceled. In the event Go Daddy deletes Your Services because they are being used in association with spam or morally objectionable activities, no refund will be issued. You agree You will not be entitled to a refund of any fees paid to Go Daddy if, for any reason, Go Daddy takes corrective action with respect to Your improper or illegal use of its Services.

In registrar parlance, terminating your service means they'll take it away from
you. You go to Court if you want to dispute that.

if you're offering proxy services and the user of your proxy have used it as email relay and he/she spammed you're also accountable for spam and abuse even if you don't do it yourself.

Domain servers in listed order:
NS1.SUSPENDED-FOR.SPAM-AND-ABUSE.COM
NS2.SUSPENDED-FOR.SPAM-AND-ABUSE.COM

the only way to get out of here is pay godaddy.com the fees required for it to be removed from suspension.

Wow, that's really #@%! Did you run a site that offers proxy serverlist or is the site a proxy server?

why they dont allow proxy sites ?? this is my first question

second this is really f****d up, they can't take the domain ... its diff TOS.

I think its just to make some $$.... this is a fraud case ...

it is like you work for me and you make a mistake ... and i took over your property and asking you to pay for it rather than firing you from the job...

The site was running PHProxy, and it was up only 2 days, while i was fixing my own server.

I'm gonna make GoDaddy lose more then $50 on this.. Pay back time.

Those registrars... If anything they should ban all other PHProxy domains first...

e.g.
CitizenLab.org
PHProxy.us
PHProxy.org
etc. etc. etc.

Well I wish you all the best!

adhesion contract... If you have deep pockets and want to fight GoDaddy in court, you may win on the argument of an adhesion contract... Talk to a lawyer if you want more details.

hi,
just take this as a lesson and move on. You are not going to make money off from the fight (unless you want to generate traffic for yourself), so it is not worth the fight.

Learn the lesson so many have learned. Do not use GoDaddy for anything. That includes GD resellers (aka WWD). For domains, use namecheap. For hosting, use a real hosting company, not a company that is mainly a domain registrar.
