I own the above domain name. Microsoft contact me asking me to give it up, so I refused. At that time, I had RSS feeds from CNN and MSNBCNN (which are freely available for non-commercial use) posting on my site. We agreed that I will take their RSS feeds off and they will not go after me. They insisted that the name was still "confusingly similar" to MSNBC but I refused and it ended at that. :hehe:

I think people should hire you to be their domain lawyer.

If you could save this one, you could save any.

I think that purely the domain does not hold that much value for MSN to file a UDRP. The doamin name in itself is worthless, and I doubt it gets natural type-in traffic.
Lawyers are not dumb and do not give out money without purpose.

But, if they wanted the domain really, you would have used it without a doubt. And will loose it in the future if they will want to.

OP - while that doesn't exactly make sense (Well, their disagreeing with you does.), what did you hope to accomplish by posting?

The accomplishment is to show us that it doesn't matter whether he has "won" this small battle. MS has taken the "livelihood" of the domain/site away by forcing him to take down the RSS feeds, which is rendering this domain useless. At the same time, if he rebuilds the site with any other conflicting content, they'll be right back, knocking on his door - just with an UDRP in hand.
What the OP is actually proud of is indeed a win for MS, they've locked all doors to using this domain in confusing or infringing fashion.

Ha. People here are so aggressive! Nonetheless, all I was trying to accomplish is share a relevant experience, that's all. Thanks for all the valuable feedback (positive or negative). The domain name can and will be used for a more interesting purpose, but that's for later down the pipeline...

funny story about bullies

I own an intelligence company and had the word intel (abreviation for intellgence) in the name. About 3 year ago I get a certified letter from intel's trademark lawyers to C&D.

Now the fun begins, being that intel was first used by George Washington when he crossed the Delaware it far preceeded intel's trademasrk application. Furhter being that intel was going after all "intel" named companies the argument was made that they where overeaching on their tm and could be sued for it. The consequences of this could ultimaly lead to there trademark being invalidated.

Make a long story short, tm issues are dual edge sword and when these fortune 500 companies start huffing and puffing they can be beaten if your intention are true.
